We help LGBTQ families obtain lawful and permanent status in the United States.

Click link to use our easy online scheduler now to sign up for a free case evaluation with LGBTQ+ Immigration Attorney Rolando Casais, Esq. or call (305) 722-8015.

Are you an LGBTQ+ U.S. citizen married to a foreign national? Here’s a breakdown of the procedure to bring your spouse to the United States.

1. File Petition for Alien Relative: This petition establishes your marriage and qualifies your spouse for a green card. This step requires that you provide verifiable evidence demonstrating a bonafide relationship.
2. Wait for Approval: Once the petition is approved, the next steps depend on whether your spouse is in the U.S. or abroad:
If in the U.S.: Your spouse can file for Adjustment of Status with USCIS.
If abroad: Your spouse will go through consular processing, where they’ll apply for an immigrant visa at the U.S. embassy or consulate in their home country.
3. Visa Interview: The consulate or USCIS will schedule an interview to confirm the legitimacy of your relationship. Be prepared for a thorough interview about your marriage, daily life, and future plans together.
4. Visa Approval & Green Card Issuance: Once everything is approved, your spouse will either receive their green card (if in the U.S.) or an immigrant visa to enter the U.S. Once they arrive, they’ll receive their green card and officially become a lawful permanent resident!

Same-sex marriages are fully recognized under U.S. immigration law, ensuring equal rights and opportunities for LGBTQ+ couples.

Need expert help? We focus our practice on LGBTQ+ immigration cases and are here to guide you every step of the way!
